Norms For Seeking Literature, Yog Sandesh & Audio-Video Material

 

         The Divya Yog Mandir (Trust), Hardwar is a well known Charitable Trust and engaged in the charitable activities for Healthy India & Disease Free World through Yog, Pranayam & Ayurved under the stewardship of world renowned Yogrishi Swami Ramdevji Maharaj.. The Trust has been providing Yogic & Ayurvedic Consultancy free of cost to general public since its inception. The Trust propagates its ideas and philosophy through publication of various Books on Yog, Pranayam & Ayurved, monthly journal Yog Sandesh and Audio Video Material. The Divya Yog Mandir (Trust) has  also its various business undertakings viz- Divya Prakashan dealing in Books & Printed Material, Divya Yog Sadhna dealing in DVds, VCDs., MP3s as well as Audio Cassettes & Yog Sandesh dealing in the work of monthly research oriented journal of Yog, Ayurved, Culture, Civilization and Education etc. to fulfill its aims & objectives.

         The Divya Yog Mandir (Trust) will appoint its authorised Retailer/ Agent for its various undertakings on following terms & conditions:

1. The D.Y.M.(T). will appoint a person/ party/ trader as authorised Retailer/ Agent for sale of products of its various undertakings.
2. The Retailer/ Agent will get itself registered with Trade Tax Authority.
3. The Retailer/ Agent will not make available any product for sale other than products of D.Y.M.(T). or products permitted to sale among people by D.Y.M.(T). at a shop situated in an easily approachable spacious building having facilities of furniture, electricity & water arrangement.
4. All goods will be supplied to the Retailer/ Agent against D.D. received in advance. In case of purchase of Audio-Video Material (VCDs., DVDs. & Audio Cassttes) the Retailer will send/ hand over D.Ds favouring "Divya Yog Sadhna" payable at Haridwar.  While in case of Books & Printed Material the D.D. should be in favour of "Divya Prakashan" payable at Haridwar. Similarly in case of monthly magazine "Yog Sandesh" the D.D. should be in favour of "Yog Sandesh" payable at Haridwar.
5. The supply of the goods will be at F.O.R. (Destination).
6. An Inspector authorised by D.Y.M.(T). will have right to inspect the premises of the Retailer/ Agent as and when required by D.Y.M.(T).
7. The expiry products or material against which any complaint is received will be replaced or settled by D.Y.M.(T).

8. The Trade discount to the Retailer will be given as under :

(a) On Electronic Audio Video items of Divya Yog Sadhna   33% on M.R.P.

     (VCDs, DVDs & Audio Cassets)   

(b) On Books & Printed Material of Divya Prakashan           25% on M.R.P.

(c) On Yog Sandesh                                                         30% on M.R.P.

N.B. The Trade Tax/ VAT will be recovered as per existing law of land from the Retailer/ Agent.

9. The Retailer/ Agent shall not sell out any product at more than M.R.P.
10. The Retailer/ Agent will maintain its books of A/c properly as per law.
11. The Retailer/ Agent shall not sell these products for further sale, expect to the branches which are permitted in writing by the D.Y.M.(T)..
12. The expenses for advertising at Local Level will be borne by the Retailer/ Agent & at National Level by the D.Y.M.(T).
13. The Retailer/ Agent will arrange a spacious part inside an easily approachable spacious building mentioned in para no. 3 above, furniture, electricity, water arrangement, OPD-Waiting, Chamber(s) for Physician(s) or any other facility needed time to time for running a Chikitisalya in the city for free consultancy to public exclusively in Yog & Ayurved.
14. The name of Chikitsalaya will be "Patanjali Chikitsalya". No fee from the patients will be charged for consultancy.
15. The Retailer/ Agent will arrange/ place an experienced Ayurvedic Physician at the Chikitsalaya trained by Divya Yog Mandir (Trust), Hardwar. The terms and conditions of a Vaid's appointment, salary & leaves etc. will be as per Model Code of Conduct supplied by Divya Yog Mandir (Trust) to the Retailer/ Agent at the time of Agreement between two parties and the Retailer/ Agent  will has to abide by the same.
16. The Retailer/ Agent will also has to abide by the other rules and regulations supplied to him/ her time to time.
17. The Retailer/ Agent will also arrange a suitable space for Yog Classes inside the premise of Chikitshalya where he/ she either himself/ herself or through an able Yog Instructor arranges teaching of Yog & Pranayam to all visitors free of cost.
18. The sign board and prescription paper and other stationery items to be provided by the Retailer/ Agent will be as per the format of the sign board and stationery provided by the D.Y.M.(T). in soft copy.
19. Incase of termination of agreement made between two parties, the Retailer/ Agent will not use Chikitsalaya, Stationery Items and will not display Sign Board as mentioned in clause (7) pertaining to D.Y.M.(T). in any way and no activity relating to Chikitsalaya shall not be carried over for two years after cancellation of the agreement, at the same place.
20. The agreement between two parties can be terminated earlier by the D.Y.M.(T)., without giving any notice, in case, it is found that any activities which is contrary to the objectives and ideals of the Trust is carried on in the premises of Chikitsalaya.
21. The Retailer/ Agent in his/ her city will work for achieving ideals and objectives of D.Y.M.(T). and also extend all assistance in collection of donation memberships for the Trust and subscriptions of Yog Sandesh etc.
22. In case of violation of any term/ condition given above, the D.Y.M.(T). will have a right to cancel the Retailership/ Agentship, forthwith without giving any notice.
23. The agreement between two parties will be initially for the duration of three years and further renewed on mutual agreed terms and conditions.
24. Any alteration or modification in terms and conditions given above shall be made on mutually decided terms/conditions.

       If anyone who is willing in the expansion of the Indian Sciences- Yog, Pranayam & Ayurved and has full faith in the objectives of the Trust and intend to seek Literature, Yog Sanesh Magazine or Audio-Video Material for further sale, may apply to Secretary General, Divya Yog Mandir (Trust), Patanjali Yogpeeth, Maharishi Dayanand Gram, Delhi Hardwar National Highway, Hardwar- 249 402 Uttrakhand, India on plain paper.

 

DO'S AND DON'TS                  NECESSARY ITEMS FOR SHIVIR

The O&I are not subject or liable to change the structure of the Yog Shivir to suit individual needs. Not all presentations at the Yog Shivir may be suitable for everyone. If pain is experienced anytime during the practice of Yog, it should be stopped immediately and a qualified health care professional should be consulted. The O&I assume no responsibility and will not be liable for any harm, injury or damage resulting from any tort, negligence or from a breach of an express or implied warranty however caused or occurring during or after participation in the Yog Shivir or while practicing anything presented therein. By participating in the Yog Shivir the participant, for himself/herself, his/her heirs, and assigns, hereby expressly assumes all risks, full responsibility and liability for participating and practicing anything presented therein and forever waives and releases and agrees to defend, indemnify and hold the O&I harmless from and against any and all claims or demands, liabilities and settlements (including without limitation, legal and accounting fees) on or against the O&I for losses or damages, including, without limitation, direct,indirect, incidental, consequential or special damages, personal injury/wrongful death, resulting from or alleged to result from participating in or practicing anything that is presented in the Yog Shivir. The O&I, at their sole own discretion reserve the right to deny participation at any time of the Yog Shivir to any entity without assigning any reason whatsoever.
